DMCA Copyright Policy
If you believe material on our website infringes a copyright you own, you can ask Cali Love Wear to remove it. Here is how notices and counter-notices work.
Our policy
Cali Love Wear respects the rights of creators and does not want infringing material offered or displayed on calilovewear.com. Should you think that something on this website, a product, a picture or any other content, infringes a copyright held by you or by someone you represent, please send a notice with the details below. We respond to notices under 17 U.S.C. § 512, the takedown provisions of the Digital Millennium Copyright Act (DMCA).
What your notice must include
Your written notice must contain all of the following:
- Signed by the right person. The copyright holder, or someone with authority to act for the holder, must sign; a physical or electronic signature both work.
- Which work. Identify the copyrighted work you say was infringed. A notice covering many works may give a representative list.
- The material in question. Identification of the material claimed to be infringing, with information reasonably sufficient for us to find it, such as the full web address (URL) of each page.
- Contact details. Name, postal address, phone and email.
- Good faith. Your statement of good-faith belief that nobody, neither the rights holder, its agent nor the law, authorized the disputed use.
- Truth and standing. Your assurance that the notice is correct, and your sworn declaration, under penalty of perjury, that the rights are yours or that their owner has empowered you to act.
Where to send it
Email the notice to [email protected] with the subject “DMCA Notice”, addressed to Cali Love Wear, Attn: Copyright Agent. Our store details are listed at the bottom of this page.
What happens next
We review complete notices promptly. Material that looks infringing is removed or made inaccessible, and where it makes sense we tell whoever supplied it.
Counter-notices
Think your material was taken down by mistake or misidentification? Send a counter-notice to that same address, containing:
- Your signature. Physical or electronic.
- What came down. Name the removed or disabled material and the page it used to sit on.
- Sworn good faith. A declaration, under penalty of perjury, that you honestly believe mistake or misidentification led to the removal or disabling.
- Who you are, and your consent. Give your name, address and phone number; state that you submit to the federal district court for the district of your address (for addresses abroad, any judicial district in which Cali Love Wear can be found); and state that you will accept legal papers served by the original complainant or by its agent.
When a valid counter-notice arrives, the original complainant may receive a copy from us, and under Section 512(g) we may reinstate the material unless they report a court filing.
Repeat infringement
Where a party repeatedly infringes copyrights, we remove the material concerned and end our business relationship with that party.
Bad-faith claims
Knowingly and materially false statements, whether claiming infringement or claiming a mistaken takedown, can make the person who made them liable under DMCA Section 512(f) for damages, costs and attorneys’ fees.
